Guilty of Plagiarism for Painting Photo of Politician

The painter Luc Tuymans has been found guilty
of plagiarism over a portrait of the Belgian politician Jean-Marie Dedecker.

Some say artistic freedom, but when the photo and painting are so similar it's hard to say it's your creation. It is always safe to use your own photographs when painting.
 It is even better to create from your own mind. This artist didn't even change the lighting.
